1. Acceptance of Terms

By accessing or using the Data Form Solution platform (dataformsolution.com), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the platform. These Terms constitute a legally binding agreement between you and Fast Flow Management, trading as Data Form Solution ("we", "us", "our").

2. Service Description

Data Form Solution provides a platform for Brand Partners to manage customer orders for wellness and phototherapy products. The platform includes order form generation, order management, customer notifications, and related tools. Data Form Solution is an order management tool and does not manufacture, sell, or ship products directly. Product fulfilment is handled separately through third-party suppliers.

3. Customer Order Process

Data Form Solution provides a public order form that allows customers to submit their personal information, product preferences, and billing details. By submitting an order through this form, you acknowledge and agree to the following:

3.1 No Direct Payment Processing

Data Form Solution does not charge your credit card or process any payment through the order form. Your payment details are collected solely to be shared with your designated LifeWave Brand Partner, who will use them to process the purchase on your behalf through LifeWave.

3.2 Data Sharing with Brand Partners

When you submit an order, your personal information (name, email, phone number, address), billing details (card type, card number, cardholder name, expiry date, CVV, and billing address), and product selections are shared with the independent LifeWave Brand Partner associated with your order. The Brand Partner will use this data to create a LifeWave account on your behalf and to purchase the products you selected. By submitting the order form, you explicitly consent to this data sharing. Brand Partners are independent third parties and are responsible for their own handling of your data once received.

3.3 Pricing, Currency, and Estimated Totals

All prices displayed on the order form are quoted in US Dollars (USD) and do not include shipping costs or local taxes (GST/VAT). When your Brand Partner processes the order through LifeWave, the USD amounts will be converted to your local currency at the prevailing exchange rate, and applicable local taxes and shipping charges will be added. As a result, the final amount charged may differ from the estimated total shown on the order form. Contact your Brand Partner for details specific to your location.

3.4 Relationship with LifeWave

Data Form Solution is not affiliated with, endorsed by, or a representative of LifeWave. The products available through the order form are LifeWave products distributed by independent Brand Partners. Data Form Solution's role is limited to facilitating order collection and transmitting order information to your Brand Partner. Any disputes regarding products, pricing, account creation, or fulfilment should be directed to your Brand Partner or LifeWave directly.

4. Account Registration

  • You must be at least 18 years old to create an account.
  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

5. Subscription & Payment

4.1 Subscription Fee

Access to the Brand Partner platform requires an active subscription. The subscription fee is $97 USD per year, billed annually from the date of your initial subscription.

4.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period (annually) unless you cancel before the next billing date. You will be charged the then-current subscription rate at the time of renewal.

4.3 Cancellation

You may cancel your subscription at any time through the billing portal in your account settings. Upon cancellation:

  • You will retain full access to the platform until the end of your current billing period.
  • After your billing period ends, your account will be locked and you will no longer have access to the platform's features.
  • You may resubscribe at any time to restore access.

4.4 No Refunds

All subscription payments are non-refundable. No partial or prorated refunds will be issued for any unused portion of a subscription period, including in cases of early cancellation. By subscribing, you acknowledge and agree to this no-refund policy.

4.5 Payment Processing

All payments are processed securely through Stripe. We do not store your payment card information on our servers. Payment disputes should be directed to us before initiating a chargeback with your bank.

Who bills you: Data Form Solution is a product of Fast Flow Management, and it is Fast Flow Management that charges your card. The charge appears on your card or bank statement as FASTFLOW.MANAGEMENT. If you see that name on your statement, it is your Data Form Solution subscription.

6. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable laws or regulations
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorised access to any part of the platform
  • Interfere with or disrupt the platform's infrastructure or security
  • Scrape, harvest, or collect data from the platform without authorisation
  • Use the platform to send unsolicited communications (spam)
  • Impersonate any person or entity
  • Share your account credentials with others

6.1 Fair Usage

Platform features — including invitations, notifications, and messaging — are subject to reasonable use limits designed to maintain service quality and prevent abuse. We reserve the right to temporarily restrict or suspend access to these features for any account exhibiting excessive, automated, or abnormal usage patterns. We may adjust these limits at any time without prior notice.

7. Intellectual Property

All content, features, and functionality of the Data Form Solution platform — including but not limited to text, graphics, logos, software, and design — are owned by Data Form Solution and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the platform without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
  • In no event shall Data Form Solution be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the platform.
  • Our total cumulative liability to you for any and all claims arising from or related to the platform shall not exceed the amount you paid to us in subscription fees during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Data Form Solution, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the platform ceases immediately. Sections 7, 8, 9, and 12 shall survive termination.

11. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the platform. Material changes will be communicated to registered users via email at least 14 days before they take effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Where you are a consumer, nothing in these Terms affects your statutory rights under the consumer protection laws of your country of residence. We will make reasonable efforts to resolve any disputes amicably. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of the jurisdiction in which you reside, unless otherwise required by applicable law.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
